TERMS AND CONDITIONS

This site is owned and operated by CIMIT UK t/a AquaLusso (‘AquaLusso, 'CIMIT', 'CIMIT UK', ’ ‘we’ or ‘us’ ‘our’), whose registered office is at Unit 2 Mill House, Hookstone Avenue, Harrogate, North Yorkshire HG2 2ER

AquaLusso is a Registered Trademark of Cimit UK Limited.

By using or accessing our website and/or placing any order(s) after viewing the website, you agree to be legally bound by these terms and conditions. If you do not wish to be bound by these terms and conditions then you may not use or access our website or place orders. 

The contract made by you with us incorporates these terms and conditions, which shall prevail over any and all terms and conditions, proposed by you. 

You shall not be able to proceed with your purchase until you have read and agreed to these terms and conditions. 

We operate in accordance will all current legislation for selling goods either face to face or distance selling. We also work closing and in accordance with Trading Standards to ensure all aspects of our business operate Legally and professionally.

These Terms and Conditions apply to the contract between the Company and the original purchaser. All rights under these terms are void when the product is sold on or ownership becomes passed to a third party (ie sold as part of a property sale. The products are sold for single family use only.

1. 

Product Specifications 

1.1 

We have a policy of continuous product development and reserve the right to amend the specifications of any goods or products without prior notice in relation to future sales or supply.

1.2 

Products supplied may differ as a consequence from those on display or advertised. Unless agreed with you, the products supplied will be of equivalent value, functionality and appearance. 

1.3 

Some items are made from quality natural wood and accordingly appearances may vary. Some woods will mellow with age and exposure to sunlight. 

1.4 

We endeavor to display as accurately as possible the colours of our products that appear on the website and in printed literature, however we cannot guarantee the complete accuracy of the pictures or photographs that are shown. 

1.5 

All steam showers, steam rooms, saunas, shower enclosures, whirlpool baths and equivalent products are delivered as self-assembly units.

 

 

2. 

Measurements 

2.1 

We will not accept any liability for any extra costs incurred by you as a result of incorrect or incomplete measurements.

2.2 

Whilst we endeavor to ensure all measurements are accurate it is possible, either through product changes or mistake, that the sizes may be incorrect. We would therefore advise that all dimensions specified by us are approximate.

 

 

3. 

Prices 

3.1 

All prices include VAT, where appropriate, at the prevailing rate and are subject to any promotional offer or discount. 

3.2 

Goods are delivered on weekdays (excluding Bank Holidays) directly to your registered card address, or other if paid by cash or cleared funds and delivery prices shown are based upon delivery within the UK mainland (contact us about other delivery areas and times). You will be notified of the delivery charge before you complete your purchase. For weekend delivery, if available, a surcharge will apply. For delivery to the Channel Islands, the Isle of Man, the Scottish Islands and other non mainland delivery locations, additional delivery charges will apply. You will be advised of these additional delivery charges if you telephone our telesales number on 0845 504 0435 before you complete your purchase. 

3.3 

The prices displayed on the website in relation to any on-line promotion are valid strictly until midnight on the day which the promotion expires unless stated otherwise by us. 

3.4 

We will not be bound to honour any prices, where we have indicated to you prior to purchase that the prices displayed have been done so in error.

3.5

Where goods are being sold as Ex-Display, we endeavor to detail all areas of damage that reflect their price. Your statutory rights are not affected, but goods cannot be returned if the reasons are in relation to the damage otherwise mentioned in the advert.

 

 

4. 

Payment 

4.1 

Full payment by credit, charge or debit card, cash or cleared funds must be made prior to the gods being dispatched. The price of any product is the price in force at the date and time of your order. You undertake that all details you provide to us for the purpose of purchasing products which may be offered by us on our website, telephone, email or other means will be correct; that the credit charge or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any products. We reserve the right to obtain validation of your credit charge or debit card details before accepting your order. 

4.2 

Payment will be taken in full at the time of the order unless the item is not in stock and you wish to place a deposit.

4.4 

We are entitled to refuse any order placed by you, at anytime.

4.5 If you wish to pay by cheque or Bank Transfer, please contact us first by phone or email. Your order will be dispatched when the cheque has cleared or the funds have been received in the back if sent by Bank Transfer.

 

 

5. 

Delivery 

5.1 

We are only able to deliver orders to you if you have a permanent address on the UK.

5.2 

Orders totaling less than 15kg may be dispatched by post or courier according. Items send by post are sent via 1st class and by courier for next day delivery. Where items (including parts) are required by the customer (or persons acting on their behalf) to be sent by other methods (such as Special Delivery or pre-9am etc), the customer (or persons acting on their behalf) will be required to make payment for the additional costs for delivery.

5.3 

For all orders - any changes made to the content of your order after it has been placed will have an impact on your delivery date. We may therefore be unable to deliver your goods on your confirmed delivery date should changes occur and if so, a new delivery date will be given.

5.4 

You are responsible for providing a safe means of access from the Public Highway to the place of delivery. If our delivery provider considers that access is unsafe then we will not deliver the goods until safe access is provided. All large items, such as steam rooms etc will arrive palletised, for more detailed information about the size of the delivery please contact us on 0845 504 0435

5.5

If you are unable, for whatever reason to take delivery of your goods on the confirmed delivery date, were not available to receive the goods or we are unable to deliver the goods due to there being no safe means of access from the Public Highways to the place of delivery we shall be entitled to charge you for re-delivery at another time and date or cancel your order.

5.6 

All our deliveries are made by third party services. If they accidentally damage goods in the course of delivery our liability for that damage is limited to the repair, replacement or refund of the goods or the value thereof.

5.7 

Time of delivery is not of the essence in these terms and conditions. We will not be liable for any loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of AquaLusso or any reasonable rescheduling of delivery.

5.8

Any damage in transit or short delivery must be noted in writing on the carrier's delivery note, at the time of delivery and notified to the Company within 2 working days (48hrs) after delivery. Where items are delivered on a Palette, you have 20 minutes at the time of delivery to check the goods and to sign the delivery note according to their condition. It is recommended that Goods are checked FULLY (opening all box contents) soon after delivery and any damages reported to ourselves, so that we may arrange replacements. Checking the goods as soon as possible after delivery will ensure that damages arising from transit are resolved before your installer commences work. Customers have a Duty of Care with the goods and should ensure they are stored safely, especially if they are to be returned. Your Statutory Rights are not affected.

 

 

6. 

Installation 

 

The products we sell require qualified trades people to fit (Plumbers/Electricians). Failure to get the product fitted by a qualified trade’s person will invalidate your warranty and we shall not be held liable for any problems or damages arising from fitting or failure. A claim must be accompanied by a fully completed installation certificate.

 

 

7. 

Returns, Refunds and Your Right to Cancel 

7.1 

You have the statutory right to return any products you have purchased within seven (7) working days of delivery for any reason (including if you simply change your mind) except if you purchased the items from or after viewing from a Showroom. To return your goods under Distance Selling Regulations (DSR) you must notify us in writing or other durable medium (includes email) within those seven (7) working days. You will then be entitled to a refund from us, which will be paid within thirty (30) days of your notice of cancellation. Please keep the product/s purchased in a saleable condition and with the original packaging where possible.
Goods must be returned to our business address: Unit 2 Mill House, Hookstone Avenue, Harrogate, North Yorkshire HG2 2ER. Goods MUST be returned with a valid RMA, which is supplied upon request to cancel the order. The customer has a duty of care over the goods and should ensure they are packaged to ensure safe transit. Where goods are returned and arrive in a poor condition; likely to have occurred during return transit, they will be photographed, and you will be notified of this matter, supplied photographs on request and a claim for the damages may be made.

7.2 

Following the 7th day following delivery, you may in certain circumstances still cancel your order and return the products you have purchased but we will retain an administration fee of 20% of the order value (up to a maximum of £50 including VAT) plus the cost of the original delivery and collection. For items ordered especially for you that are NON stock items please call.

7.3 

Subject to your statutory rights, products made or altered specifically for or on behalf of you, may not be returned nor will we provide any refund, unless they are defective or have been accidentally damaged by us in the course of delivery.

7.4 

If we deliver incorrect goods, or in the event that you discover any defect in the goods for which you require replacement, you must report the defect within 7 working days of the date you receive them by contacting our Customer Services Helpline on 0845 504 0435. Please keep the products purchased in a saleable condition and retain the original packaging in the condition it was provided. Where incorrect Goods are delivered and subsequently installed, we will NOT accept any liability. Where items are noted as damaged and installed non-the-less, we will not be held liable for any falure resulting or labour costs to re-fit parts later.

7.5 

We will not be liable for any damage or loss resulting from repairs attempted by you or third parties. 

 

 

8. 

Guarantees and Claims under Guarantee 

8.1 

The provisions of this clause 8, apply in addition to your statutory consumer rights in relation to faulty or miss-described products. These rights are not affected by the guarantee. 

8.2 

The guarantor is AquaLusso, Unit 2 Mill House, Hookstone Avenue, Harrogate, North Yorkshire HG2 2ER

8.3 

We guarantee all products against faulty workmanship and/or faulty materials for a minimum period of 12 months from the actual date of delivery. This guarantee will be extended to 5 years for Platinum models or 'Lifetime' for Pure Range models once we have received your Warranty Form, which must be fully completed and returned within 60 days of recipt of the goods being delivered. For full details on Warranty cover, please read the Warranty page of the website.

8.4 

These guarantees do not cover fair wear and tear; neglect; abuse or misuse of your goods; loss or damage due to fire, smoke, water, lightning, sunlight, weather, rusting, corrosion, theft or explosion; accidental damage or loss or damage caused by a third party. The guarantee excludes bulbs, lights and fluorescent tubes. The Warranty also exludes cover on parts that fail due to Limescale build up.

8.5 

In the event of a claim under guarantee occurring, please phone our Customer Services Helpline on 0845 504 0435. 

8.6 

We will arrange to repair or replace the defective or incorrect item free of charge within the Warranty. Were we arrange to repair the part, the part may be required to be returned to us to do so or we may arrange an onsite repair at our discretion. Should a part no longer be available, it will be replaced with a part that most closely matches it. 

8.7 

We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered products over and above the value of the goods themselves. This does not affect your statutory rights. We will not be held liable for damage incurred through neglegence of your installers, this includes but not exclusively where pipework as not been checked and tightened up (all showers/whirlpool etc) come with some preassembled connections. These may have not been fully tightened during manufacure and or may loosen in transit.

8.8

All our Shower Cabins are designed to be free standing. You must ensure you are able to gain access to the rear of the product to inspect or attend to the hoses and electrical connections should the need arise. We will consequently not be liable for costs incurred by fitters needing to fit replacement parts on units that are fastened to the fabric of the property, sealed in, boxed in or otherwise installed into modified or awkward to access locations.

8.9 Where parts are supplied under Warranty to repair a fault that has been identified we will cover costs incurred by having your plumbing or bathroom fitter return to install the replacement part providing it is within 28 days of delivery of your product (where a part is not in stock to dispatch immediately from us, this timescale will adjust to allow for re-stocking). The costs claimed must be deemed reasonable (see also 8.8 above) We are also not liable for costs incurred by late deliveries where the fitter is waiting for goods/items to arrive, where we (AquaLusso/CIMIT UK) have dispatched the goods on time, but the delivery is delayed or failed beyond our control. All parts are subject to delivery charge to cover postage and packaging.

 

 

9. 

Site Content and Disclaimers 

9.1 

Every effort is made to ensure the complete accuracy of our website, however some prices/details contained on the website may change from time to time and it is possible that errors will occur. We will use our best endeavors to rectify any errors, as swiftly as possible but we cannot be responsible for any losses incurred. 

9.2 

To the maximum extent permissible by law, we exclude all warranties, express or implied as to the accuracy of the information contained in any of the materials on this website. We cannot accept liability for any particular material on the website or as a result of any use of or reliance placed upon the information contained on this website.

9.3 

Any material downloaded or otherwise obtained through the use of this website is done at your own discretion and risk and that you will be solely responsible for any damage to your own computer system or loss of date that results from the download of any such material. 

 

 

10. 

Applicable Law 

10.1 

We control and operate the web site from our offices within England. Accordingly the laws of England and Wales govern claims relating to, including the use of, this web site and the materials contained therein. If you choose to access our web site from outside England and Wales you do so on your own initiative and you hereby agree that in the event of a dispute between Bathtek and you the laws of England and Wales will apply at all times.
